1. Acceptance of Terms

By accessing or using Florafolio ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Florafolio provides tools for cataloguing plant collections, including a shared botanical index, private collection and plant records, photographs, mapping, offline synchronisation, and subscription management.

3. Free and Paid Plans

Florafolio may be used free of charge within the limits published on our pricing page. Florafolio Pro is US$4.99 per month and is billed through the app store that processes your purchase. Features, prices, and billing periods may be updated as the Service changes.

4. User Accounts

You must create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

5. Acceptable Use

You agree not to misuse the Service, including attempting to access it in unauthorised ways, uploading malicious code, or using it for any unlawful purpose.

6. Intellectual Property

All content, features, and functionality of the Service are the exclusive property of Florafolio and its licensors and are protected by intellectual property laws.

7. Contributed Botanical Data

Botanical records you contribute to the shared index — including names, authorship, common names, and native ranges — become publicly available to other users, and you grant us a perpetual, non-exclusive licence to publish them as part of the index. Your own plants, notes, photographs, and map positions remain private to your account unless you publish a collection.

8. No Professional Advice

Botanical identifications, common names, and other horticultural information in the Service are provided for reference only, may be unverified or contributed by other users, and are not advice on the safety, edibility, toxicity, or legality of any plant. Consult a qualified professional before acting on any identification.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Florafolio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Reviewed" date above. Continued use of the Service constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of New Zealand unless mandatory local law says otherwise.
